This Privacy Policy describes how ARE Outrigger World Inc ("we," "us," or "our"), a California corporation operating the AllAdaptivFitness program through the website https://alladaptiv.com (collectively, the "Services"), collects, uses, shares, and protects your personal information. This Policy is designed to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act ("CCPA/CPRA"), the California Online Privacy Protection Act ("CalOPPA"), the Telephone Consumer Protection Act ("TCPA"), the Children's Online Privacy Protection Act ("COPPA"), and the CTIA Messaging Principles and Best Practices.
ARE Outrigger World Inc is a California corporation. We operate the AllAdaptivFitness adaptive fitness training program through the website https://alladaptiv.com. Our mailing address is 38 Vacaville, Irvine, CA 92602. You can reach us at alerts@alladaptiv.com or +1 (949) 394-8707.
We collect only the personal information necessary to enroll participants in our adaptive fitness programs and to deliver appointment-related notifications. Using the statutory categories set forth in Cal. Civ. Code § 1798.140(v), we collect the following:
We do not collect biometric information; geolocation beyond coarse server-log IP; audio, electronic, visual, thermal, or olfactory information; or sensitive personal information as defined in Cal. Civ. Code § 1798.140(ae), except that your SMS content with us may incidentally contain information you choose to send, and health information is collected only as described above with your express consent.
Text-message originator opt-in data and consent — including the fact that you opted in, the timestamp, the keyword you used, and the mobile number you used — is collected and treated separately, as described in Section 6.
We collect personal information directly from you (when you enroll, book a training session, opt in to SMS, or contact us), from a parent or legal guardian when the participant is a minor, from our coaches who enter your information into our booking system on your behalf, and automatically from your device when you visit our website (via standard server logs and essential cookies).
We use personal information only for the following business and operational purposes:
We do not use personal information for targeted advertising, profiling that produces legal or similarly significant effects, cross-context behavioral advertising, or any commercial purpose unrelated to the delivery of the AllAdaptivFitness program.
We share personal information only with the following categories of service providers and contractors, each of which is contractually restricted to processing your information on our behalf for the purposes listed in Section 4:
No sale or sharing of personal information. We do not sell, rent, or share your personal information for monetary or other valuable consideration, and we have not done so in the preceding 12 months. We do not share personal information for cross-context behavioral advertising. Because we do not sell or share personal information, we do not provide a "Do Not Sell or Share My Personal Information" link; this Policy serves as your notice of that practice.
Mobile information — special no-sharing commitment. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Minors under 16. We do not knowingly sell or share the personal information of consumers we know to be under the age of 16.
When you opt in to the AllAdaptivFitness SMS program by texting the keyword START to our designated SMS number, +1 (949) 810-1380, we collect and store your mobile number, the timestamp and method of your opt-in, your opt-in keyword, and a log of messages sent to and received from you. The SMS number used for the program is published on our SMS Terms page at https://alladaptiv.com/sms-terms. This SMS data is used solely to deliver the appointment-notification service described in Section 4 and to document your consent as required by the TCPA and CTIA.
By opting in, you agree to receive SMS text messages from AllAdaptivFitness for appointment confirmations, reminders, reschedule notices, and cancellation notices related to personal training sessions you have booked. Coaches who opt in also receive operational alerts when a member books or cancels a session with them. Consent is not a condition of any service or purchase. Message frequency varies based on your booking activity (typically 5–20 messages per month). Message and data rates may apply.
Reply STOP to any message at any time to stop receiving texts. You will receive one confirmation message and no further texts will be sent. You may also reply END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, or OPTOUT. Reply HELP, email alerts@alladaptiv.com, or call +1 (949) 394-8707 for assistance.
We do not share or sell SMS originator opt-in data or consent with any third party for any purpose, including marketing and promotional purposes.
See our SMS Terms & Conditions for program details.
We retain personal information only as long as reasonably necessary for the purposes described in Section 4, or as required by law:
When the applicable retention period ends, we securely delete or de-identify the information.
If you are a California resident, you have the following rights under the CCPA/CPRA:
Submit a verifiable consumer rights request through one of the following:
We will acknowledge your request within 10 business days and respond within 45 days (extendable by an additional 45 days with notice). To verify your identity, we will ask you to provide information we already maintain about you and match it against our records.
You may designate an authorized agent to submit requests on your behalf. The agent must provide written permission signed by you, and we may require you to verify your identity directly and confirm the authorization.
Our website processes Global Privacy Control (GPC) signals as valid requests to opt out of the sale or sharing of personal information. Because we do not sell or share personal information, GPC signals are acknowledged but result in no operational change.
California Civil Code § 1798.83 permits California residents who have an established business relationship with us to request information, once per calendar year, about our disclosures of personal information to third parties for those third parties' direct marketing purposes. We do not share personal information with third parties for their direct marketing purposes. To make a Shine the Light request, email alerts@alladaptiv.com with the subject line "California Shine the Light Request."
Our website does not currently respond to "Do Not Track" browser signals, because no uniform industry standard for responding to DNT has been adopted. We do honor Global Privacy Control signals as described in Section 10. We do not authorize third parties to collect personally identifiable information about your online activities over time and across different websites when you visit https://alladaptiv.com.
We maintain reasonable administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, disclosure, alteration, or destruction, consistent with Cal. Civ. Code §§ 1798.81.5 and 1798.100(e). These include access controls, encryption in transit, limited staff access on a need-to-know basis, and periodic review of our security practices. No method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
For participants under 18, registration must be completed by a parent or legal guardian. We collect information about minors only to provide services and only with guardian consent. We do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act, and we do not knowingly sell or share the personal information of any consumer under the age of 16 within the meaning of the CCPA/CPRA. If you believe we have collected information from a child in violation of this Policy, contact us at alerts@alladaptiv.com and we will promptly delete it.
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top and, if the changes are material, provide reasonable notice. We review this Policy at least every 12 months.
